General Terms & Conditions – Ebonjalo

These General Terms & Conditions (“Terms”) apply to all services offered under the name Ebonjalo, operated by JANBOELO, our parent company registered in the Netherlands. By booking a safari or related service with us, you acknowledge that you have read, understood and agreed to these Terms.

Future bookings may be managed directly through a Ugandan subsidiary once established.

2. Applicable Law and Jurisdiction

These Terms are governed by Dutch law, with recognition that services take place in Uganda and are therefore also subject to Ugandan rules and regulations where applicable. Any disputes shall primarily be handled under Dutch jurisdiction, unless mandatory Ugandan regulations apply to the services rendered locally.

3. Services and Prices

  • Services include those stated in the confirmed itinerary (e.g. accommodation, meals as indicated, park fees, transfers, guiding).
  • Excluded are: international and domestic flights, visas, travel insurance, drinks, tips, laundry, and personal expenses unless otherwise agreed.
  • Prices on the website are quoted in USD. On request, we may issue offers or invoices in EUR.
  • VAT: Dutch VAT may apply to clients based in the EU. Where applicable, this will be specified on the invoice.
  • Prices may change before confirmation due to exchange rates, permit fees, or supplier increases. Once confirmed in writing, the agreed price is binding.

4. Bookings and Payments

  • Bookings can be made up to 12 months in advance, subject to availability.
  • A non-refundable deposit is required to secure the booking. Gorilla and chimpanzee permits require 100% advance payment. Accommodation providers may require 75–100% advance payment.
  • Payments can be made via bank transfer or other agreed methods. Transaction fees from the client’s bank are the responsibility of the client.
  • The full trip price must be received by Ebonjalo no later than 14 days before the start of the trip. Travellers will not be entitled to participate in the safari if full payment has not been received.
  • Failure to pay may result in cancellation (see cancellations and refunds).

5. Cancellations and Refunds

Cancellations must be sent in writing (from the same email address or WhatsApp number used for the booking) and confirmed by us in writing.

  • 61 days or more before departure: refund of deposits minus non-refundable costs and USD 75 administration fee per person.
  • 60–31 days before departure: 50% of trip cost charged.
  • 30–16 days before departure: 75% of trip cost charged.
  • Within 15 days of departure: 100% of trip cost charged.

No refunds will be made for unused services, missed departures, or leaving a trip early.

6. Minimum Age

Children from 2 years are welcome. All travellers under 18 must be accompanied by a parent or guardian.

7. Physical and Medical Requirements

Safaris may involve walking in uneven terrain and humid climates. A reasonable fitness level is required. Travellers are responsible for ensuring they are medically fit to participate and must disclose relevant health conditions before booking.

8. Travel insurance

All travellers are required to have valid travel and health insurance that covers medical expenses, emergency evacuation, repatriation, trip cancellation and personal belongings. It is the sole responsibility of the client to arrange such insurance in their home country before departure. Ebonjalo does not verify insurance policies and cannot be held liable for any costs incurred as a result of travelling without adequate insurance.

9. Modifications of Itineraries

Where possible, we will accommodate modifications requested by clients. Additional costs may apply. Ebonjalo reserves the right to adjust itineraries in case of unforeseen circumstances (weather, closures, safety concerns).

10. Liability

  • Participation in safaris is at the traveller’s own risk.
  • Ebonjalo/JANBOELO is not liable for loss, damage, injury, delay, or expenses caused by third parties, wildlife, poor road conditions, or circumstances beyond our control.
  • Vehicles are maintained to high standards, but breakdowns or delays may occur.
  • Guides’ instructions must always be followed.
  • Maximum liability is limited to the amount paid for the booked service, unless otherwise required by mandatory law.

11. Wildlife

Wildlife sightings cannot be guaranteed. Gorilla and chimpanzee permits provide the right to participate in tracking but do not guarantee sightings.

12. Force Majeure

Ebonjalo is not responsible for failure to deliver services where prevented by force majeure – events beyond our reasonable control.

Force majeure includes but is not limited to: natural disasters, extreme weather, fire, epidemics or pandemics, war, terrorism, civil unrest, strikes, government actions, road closures, or park restrictions.

In such cases:

  • We will make reasonable efforts to offer alternative arrangements.
  • Refunds cannot be guaranteed. Any decision regarding refunds will depend on circumstances and the policies of suppliers (e.g. lodges, national parks).

13. Complaints and Dispute Resolution

  • If you have a complaint, you must notify us immediately so we can attempt to resolve it during your trip.
  • If unresolved, you may submit a written complaint within 14 days after your trip ends.
  • As required under EU law, you may also use the Online Dispute Resolution platform (ODR) of the European Commission: https://ec.europa.eu/consumers/odr.

14. Privacy

We process personal data in accordance with our separate Privacy Policy, available on our website.

15. Exclusion of Withdrawal Right

According to Article 16(l) of the EU Consumer Rights Directive (2011/83/EU), the right of withdrawal does not apply to contracts for accommodation, transport, car rental, catering, or leisure activities that are linked to a specific date or period.

As our services involve safaris, accommodation and related travel arrangements for fixed dates, bookings with Ebonjalo are therefore not subject to a right of withdrawal or a 14-day cooling-off period.

16. Final Provisions

By confirming a booking, you accept these Terms. If any clause is found invalid under applicable law, the remainder of the Terms remains valid.
